Unemployment subsidy for people over 52 in Spain
If you are 52 or older and have exhausted your the unemployment benefit based on contributions (paro) or meet another SEPE-compatible access situation in Spain, you may qualify for the subsidio para mayores de 52 años. SEPE pays around €480/month and — crucially — continues paying Social Security contributions for your future pension until you reach retirement age.
What is the subsidio para mayores de 52?
The subsidio para mayores de 52 is an unemployment subsidy managed by SEPE for workers aged 52 or older who have used up a prior benefit. Unlike the contributory the unemployment benefit based on contributions (paro), it is not based on how many months you contributed — it is means-tested against your personal income.
Its defining feature is pension protection: while you receive it, SEPE pays Social Security retirement contributions for you at 125% of the minimum contribution base. The years you spend on this subsidy count toward your future pension.
The subsidy can continue until you reach the ordinary retirement age required for a contributory pension, unless you start working or stop meeting the requirements before then.

Requirements in detail
All conditions must be met simultaneously. SEPE checks them at application and at each annual renewal. The requirement that causes most refusals is the income limit (límite de rentas): 75 % of the SMI, counting only your own income.
- Age ≥ 52 — checked on the day you submit the application, not when your previous benefit ended.
- Compatible access situation — you must have exhausted a qualifying benefit or meet another SEPE access situation; RAI, cese de actividad and the extraordinary unemployment subsidy do not open this route by themselves.
- 6 years of unemployment-protection contributions in Spain — plus the contribution requirements for a contributory retirement pension, except for age.
- Personal income ≤ 75 % SMI — only your own income counts, not your spouse’s. The 2026 threshold is €915.75/month.
- No incompatible pension — partial retirement and certain disability pensions may be compatible depending on the exact benefit and pension type.
- Registered as job-seeker — you must be actively registered at the employment office (demandante de empleo).
Amount and duration
Monthly amount: 80 % of IPREM. In June 2026, IPREM is €600/month, so the 52+ subsidy is €480/month.
Duration: The subsidy runs until you reach the ordinary retirement age required for a contributory pension. It renews every 12 months as long as you continue to meet the requirements: you must file an annual income declaration (declaración anual de rentas) with SEPE within 15 working days after each 12-month period (counted from the subsidy’s start or last resumption), or both the payment and the pension contribution are interrupted until you file it.
Retirement-contribution bonus: SEPE pays your Social Security retirement contributions at 125% of the minimum contribution base while you are on the subsidy. Your pension accrual does not stop.
Documents to submit
- National identity document or valid residence card (NIE / TIE).
- Social Security affiliation number (número de afiliación).
- Employment history certificate (informe de vida laboral) — obtainable from the Social Security website with your a digital certificate.
- Bank account details (IBAN) for direct deposit.
- Income declaration (declaración de rentas) or most recent tax return (declaración de la renta) if you filed one.
- If applicable: family book (libro de familia) or documentation of dependants.
- Proof of job-seeker registration at the employment office (you are usually already registered when you arrive to apply).

Common refusal reasons
- Income above the threshold: Even a small pension, rental income, or investment return can push you over the 75 % SMI limit. Check all income sources before applying.
- Age below 52 on application date: SEPE uses the exact calendar date of application. If you are 51 years and 11 months old, you will normally need to wait until you turn 52.
- Prior benefit not fully exhausted: Voluntary resignation or a SEPE sanction may mean you do not qualify.
- Insufficient contributions: fewer than 6 years effectively contributed in Spain for unemployment protection, or not meeting the contribution requirements for a contributory retirement pension.
- Registration lapse: If your job-seeker registration expired and you did not renew it on time, SEPE can refuse or suspend payment.
- Missing or incorrect documents: Particularly the income declaration — SEPE cross-checks with the Tax Agency (AEAT).
How to apply
Book a SEPE appointment (cita previa) online at sepe.es or by phone — bring all documents listed above.
Submit form SEPE-003 at your SEPE office, or through the SEPE online portal if you have a a digital certificate.
SEPE will issue and notify the resolution. If it refuses, suspends or pays incorrectly, or if administrative silence applies, you can appeal.

Can I receive the subsidy 52+ and work at the same time?
Yes, within limits. Since the 2024 subsidy reform (Real Decreto-ley 2/2024, applicable to subsidies starting from 1 November 2024), the 52+ subsidy is compatible with part-time work and — through the complemento de apoyo al empleo (employment support supplement) — even with full-time employment, for a maximum of 180 days. Always inform SEPE before you start working; failing to do so leads to repayment and possible sanction.
Is the benefit for people over 52 contributory or not?
It is not contributory — it is an asistencial (means-tested) unemployment subsidy: the amount does not depend on your previous salary. Its special feature is that SEPE does pay retirement contributions for you at 125 % of the minimum contribution base while you receive it, which ordinary subsidies do not include.
52+ subsidy or non-contributory pension (pensión no contributiva) — which one applies to me?
They are different benefits. The subsidio para mayores de 52 años is a SEPE unemployment subsidy for people who can work and are registered as job-seekers. The non-contributory retirement pension (PNC) is claimed from age 65 through IMSERSO or your regional social services when you have not contributed enough for a contributory pension. Between 52 and retirement age, the benefit to check first is the 52+ subsidy.
What is the income limit (límite de rentas) for the over-52 subsidy?
Your own income may not exceed 75 % of the SMI — €915.75/month in 2026 (SMI of €1,221/month, Royal Decree 126/2026). Only your personal income counts, never your spouse’s, and SEPE re-checks it at application and at each annual income declaration.
How much is the over-52 subsidy in 2026?
80 % of the IPREM. With the 2026 IPREM at €600/month, that is €480/month. The 2024 reform raised the initial amounts of other unemployment subsidies in phases, but the 52+ subsidy keeps a flat 80 % of IPREM for its whole duration.
Do I apply at INEM or SEPE?
They are the same body: INEM no longer exists — since 2003 it has been called SEPE (Servicio Público de Empleo Estatal). If you are looking for “INEM benefits for people over 52”, this is that subsidy, and you apply at a SEPE office with cita previa or through the SEPE online portal.
Which law regulates the over-52 subsidy?
Articles 274 et seq. of the General Social Security Law (Royal Legislative Decree 8/2015, LGSS), as amended by Real Decreto-ley 2/2024 of 21 May, which reformed the asistencial level of unemployment protection and applies to subsidies starting from 1 November 2024.
Does the subsidy count toward my retirement pension?
Yes. SEPE pays your Social Security retirement contributions at 125% of the minimum contribution base while you are on the subsidy. Those contributions count for the amount of your future pension, although not toward the minimum qualifying period — which you must already meet to access this subsidy. This is one of the most valuable features of the subsidio para mayores de 52.
What happens when I reach retirement age?
The subsidy ends when you reach the ordinary retirement age required for a contributory pension. SEPE will notify you and you should apply for your pension. If contributions are insufficient, you may qualify for the non-contributory retirement pension (pensión no contributiva).
Until when is the subsidy paid, and how is it renewed?
Until you reach the ordinary retirement age that gives access to a contributory pension. However, every 12 months you must submit the annual income declaration to SEPE within the following 15 days; if you do not, payment is interrupted until you file it.
Does my spouse’s income affect my eligibility?
No — only your own personal income is assessed against the 75 % SMI threshold. Your spouse’s income does not count.
What if SEPE refuses my application?

Can I receive this subsidy after RAI or another subsidy?
Not after RAI, cese de actividad or the extraordinary unemployment subsidy by themselves. It can fit after contributory unemployment or another SEPE-compatible situation if you meet all the 52+ requirements.
