Fake lawyer in Spain: how to check an abogado or gestor before paying
In Spain, abogado and gestor administrativo are not casual labels. They are professional statuses that can be checked. This guide shows what to verify before you pay, send documents or sign an authorisation.
Why the brand is not enough
A person may sound professional, refer to a known brand or a large online platform, and speak confidently about your case. None of that proves that this person is a licensed professional, that they may represent you, or that they will remain accountable after payment.
This is not an “anti-lawyer” article. Good abogados and gestores are essential when a case truly needs them. The point is simpler: verify the specific person before you pay, send a passport, share a NIE/TIE, give access to Cl@ve or sign an autorización.

Who is who: abogado, gestor, asesor or “helper”
In Spain, similar words can mean very different legal and practical roles.

What to check before paying: 8 checks
These checks do not require legal training. A real professional should be able to answer them clearly.
Ask for the full name and both surnames. A nickname or first name is not enough.
Check the number in the Censo General de Letrados. If the name and number do not match, stop.
Check the professional through Consejo General de Gestores Administrativos or the local Colegio de Gestores.
Ask whether the person is an employee, an external professional or a subcontractor, and who is responsible if something goes wrong.
Ask for a hoja de encargo or service contract: scope, exclusions, timing, price, IVA, invoice and complaint route.
You should know who issues the factura, for what service and whether IVA is included.
Do not sign a broad autorización without knowing what it permits, where it will be used and how you can revoke it.
Do not share Cl@ve, certificado digital, passwords or full document sets until you know who is processing them and why.
A real case: the “lawyer” in an online advert and two bank accounts
A man advertised online as a practising lawyer although he was not one. A client paid him €2,120 for steps that were never carried out. The client sought help to avoid serving a seven-month prison sentence. The fake lawyer convinced him that the required steps were under way: €1,970 went to the accused man’s account and another €150 to a joint account held by the man and a woman, who disposed of that amount immediately. Before the Audiencia Provincial de Cantabria, the man admitted the facts and accepted conviction for continuous fraud.
The non-obvious detail. Professional vocabulary and an online listing do not prove status. After payment, the provider’s profile is not the only evidence: preserve the account holder’s name, IBAN and receipt for each transfer. Here, a separate payment to a joint account connected a second person to the episode.
Outcome: the man received two years in prison; the woman was fined €180 for continuous minor fraud. Civil liability required €1,970 from the man and a further €150 jointly from both convicted persons.
Limits of the case. This was an agreed conviction on specific facts, not a rule that every failed service is criminal. Fraud requires evidence of deception and receipt of money; poor service may instead be a contractual, consumer or disciplinary dispute. Checking the official register before payment reduces risk but does not guarantee the outcome of a later claim.

One sign is not always proof of fraud, but each one means you should pause before paying.
- No full name or register number
- Payment requested to a personal Bizum or a third person
- “Pay now, contract later”
- “Without factura it is cheaper”
- Pressure, urgency or guaranteed result
- Requests for Cl@ve, certificado digital, email password or broad authorisation
- It is unclear who is responsible if the service is not provided correctly
- If you found the person through an online platform or marketplace, they ask to move everything to WhatsApp, Telegram or personal email without a written record in that platform
If you already paid and the person disappeared
Act methodically. Preserve evidence before emotions or public accusations make the situation harder.
- Save screenshots, bank proof, Bizum receipt, emails, phone numbers, ads, contracts and all documents shared.
- Send a written demand asking for the service status or refund within a clear deadline.
- Report the issue to the platform if the contact came through one.
- Check the professional registers and keep proof of the search.
- If the person is a real abogado or gestor, consider a complaint to the relevant colegio.
- If there are signs of deception, file a denuncia with Policía Nacional or Guardia Civil.
- If you paid by card, ask your bank immediately about dispute or chargeback.
- If you shared credentials, change passwords, revoke certificates and secure your accounts.

How do I check if someone is a real abogado?
Ask for the full name, both surnames and número de colegiado. Then check the official Censo General de Letrados.
Is Bizum to a personal number always fraud?
Not always, but it is a serious warning sign if there is no contract, invoice or clear professional identity.
Can I complain to a Colegio de Abogados?
Yes, if the person is or was an abogado colegiado. If the person was never an abogado, the route may instead be a police denuncia or consumer/data complaint.
