The deadline runs from the notification date (notificación), not the INSS decision date. Key IMV deadlines:

Why IMV is refused — and what to challenge

Most refusals come down to one of these grounds:

Income / assets over the threshold

Often only on paper — a one-off payment or assets that produce no income.

Wrong unidad de convivencia

Someone extra included or left out; a mismatch with the padrón.

Padrón does not match

Less than a year at the address, or a household that differs from the application.

Residence out of date

For non-EU: the NIE/TIE has expired or is not valid on the filing date.

Important: the reclamación must answer the exact reason INSS gave. A generic “I disagree” rarely works — NAVI helps you respond to the point.

Common questions

Do I need a lawyer? +

No. The reclamación previa is a mandatory pre-court step you file yourself. A lawyer is only needed if it goes to court (demanda).

File again or appeal? +

Appealing is usually better: if you win, payment is set from your first application date. Re-filing means a new date, with no payment for the missed period.

What is silencio administrativo? +

If INSS does not reply within 6 months, the law treats it as a refusal (denegación presunta). From that point the 30-working-day deadline for the reclamación previa runs.
