IMV Denied in Spain: How to File a Reclamación Previa for Minimum Vital Income
INSS denied your Ingreso Mínimo Vital — this is not the end. You have 30 working days from the notification date to file a reclamación previa and challenge the decision. The denial is not final
A resolución de denegación from INSS is an administrative first-level decision. Spanish law requires a mandatory pre-court step before any dispute can go to a social tribunal: the reclamación previa al INSS (Article 71, Ley Reguladora de la Jurisdicción Social — LRJS).
A reclamación previa is a written objection you submit to INSS. They review the decision again, taking into account your arguments and any new documents you provide. In practice this matters: many denials result from errors in the household composition, documents that were missing at the time of the original review, or income that was incorrectly calculated — all of which can be corrected.

What is IMV
Ingreso Mínimo Vital (IMV) is a monthly state benefit created by Ley 19/2021. Its purpose is to support individuals and families in situations of economic vulnerability (vulnerabilidad económica). It is administered and paid by INSS (Instituto Nacional de la Seguridad Social).
- Amount depends on the composition of the household unit (unidad de convivencia) and is indexed annually.
- Who can apply: Spanish citizens and foreign nationals with legal and effective residence in Spain for at least the immediately preceding year; normally from age 23, with specific exceptions, and always within the income and patrimony thresholds.
- Income and asset limits: the combined income and patrimony of the entire household must fall below the established threshold.
- Compatibility with work: IMV can be combined with employment under the incentive exemption rules — this must be correctly declared in the application.
7 common reasons for denial
INSS must state the reason for the denial in the resolución. The most frequent grounds are:
- 1. Income or asset (patrimonio) threshold exceeded. INSS calculates the household's income for the previous year. A one-off payment or an asset that generates no actual income can push the figure above the threshold on paper.
- 2. Error in the household unit (unidad de convivencia). A household member was incorrectly included or excluded; one member's income pulls the household over the threshold; the padrón data does not match the application.
- 3. The household unit is not properly proven. The household does not appear to have existed for at least 6 months, or the address or household composition in the padrón does not match the application.
- 4. No legal residence at the time of application. For non-EU nationals: the NIE/TIE had expired or was not valid on the date the application was filed.
- 5. Economic vulnerability not proven. Income data was incomplete or contradictory; INSS could not verify the situation and defaulted to denial.
- 6. Incomplete document pack. One or more required documents were missing at the time of review; INSS issued a decision without them.
- 7. Silencio administrativo. INSS did not issue a decision within 6 months — by law this is treated as a denegación presunta (presumed denial).

- 6 months — maximum time INSS has to issue a decision. No decision after 6 months = silencio administrativo = denegación presunta.
- 30 working days — deadline to file the reclamación previa, counting from the notificación date (or from the end of the 6-month period in the case of silencio). Working days exclude weekends and public holidays.
- 45 days — legal deadline for INSS to answer the reclamación previa. If there is no response by then, the reclamación is treated as denied by administrative silence.
- 30 working days — deadline to file a claim before the social court (jurisdicción social) after receiving the INSS response to the reclamación previa or after a presumed denial by silence.
How to read the INSS rejection letter
Before drafting the reclamación previa, carefully read every part of the resolución:
- Notificación date. This is when the 30-working-day clock starts — the date you received the letter, not the date INSS issued the decision.
- Stated reason for denial. INSS must give a specific ground. This is exactly what you are contesting.
- Income period used. Which tax year was taken into account, which income sources are listed. Compare against your own IRPF records and pay slips.
- Household composition as determined by INSS. Check it against your certificado de empadronamiento colectivo.
- List of documents considered. If a document you submitted is missing from the list, or a document you never provided appears, flag it in your reclamación.
- Expediente number. Required for the reclamación previa header; usually shown at the top of the resolución.
- Factual errors. Wrong NIE, incorrect date of birth of a family member, wrong address — any of these is independent grounds for revision.

A reclamación previa is your opportunity to supplement the file with documents that were missing at first review. Collect the full set before you draft anything.
- Resolución de denegación (INSS denial letter) + justificante de notificación
- Copy of the original solicitud IMV + justificante de presentación (with submission date)
- Empadronamiento colectivo — the certificate listing all residents at the address. Request it from the ayuntamiento.
- Informe de vida laboral (request via sede.seg-social.es or the Tu Seguridad Social app)
- IRPF tax return for the latest available year, or a certificate of non-obligation to file
- Income certificates: nóminas, pensions, unemployment benefit — for the period INSS used in its calculation
- NIE/TIE + autorización de residencia for all household members aged 16 or over
- Family documents: libro de familia, birth certificates of dependent children if applicable
- Copies of all previous correspondence with INSS: document requests, submission receipts
- Any additional documents that directly address the stated reason for denial

The reclamación previa is submitted to the same body that issued the decision — INSS. Follow these steps:
- Calculate the deadline. Open the resolución, find the notificación date, count 30 working days forward (excluding weekends and public holidays). That is your last day.
- Identify exactly what you are contesting. Re-read the stated reason for denial. List the specific errors or disputed points, with supporting arguments and references to the documents you are attaching.
- Collect your documents. Focus on the documents that directly address the denial reason: empadronamiento colectivo, income certificates, family composition records.
- Draft the reclamación previa. Include: your full name, NIE/DNI, IMV expediente number, date of the resolución, specific grounds of disagreement, explanation of what is incorrect and why, and a list of attached documents. Be clear and factual.
- Submit it. Three equivalent options: (a) via the IMV portal; (b) via the Social Security sede electrónica (requires Cl@ve or a certificado digital); (c) in person at an INSS registro office — bring two copies and ask for a date-stamped copy for yourself.
- Keep the justificante de presentación. The receipt showing the submission date and entry number is your key document. Without it, proving timely submission is difficult.
- Wait for INSS to respond. INSS will issue a new resolución. If they deny again or do not respond, you may bring a claim before the social court (jurisdicción social). See active cases for examples of similar situations.

Can I reapply for IMV instead of filing a reclamación previa?
Yes, but a new application is treated as a new case. You lose the economic effects tied to the original application, normally from the first day of the month after that application. A successful reclamación previa can preserve IMV with those original effects. If the deadline has not passed, the reclamación previa is usually the better route.
What is silencio administrativo and when is INSS considered to have refused?
INSS must decide on your IMV application within 6 months. If no decision is issued, the law treats the silence as a denegación presunta (presumed denial). The 30-working-day window for the reclamación previa begins from that point. You can obtain written confirmation of the absence of a decision via the Social Security sede electrónica.
Do I need a lawyer to file a reclamación previa?
No. A reclamación previa is an administrative step, not a judicial one. You can file it yourself. A lawyer becomes necessary only if INSS refuses again and the dispute goes to a social court (jurisdicción social).
Can a foreigner without Spanish citizenship receive IMV?
Yes, if you have had legal and effective residence in Spain for at least the immediately preceding year. Non-EU nationals need a valid autorización de residencia (NIE/TIE) at the time of application. You must also meet the age, household-unit and income threshold requirements.
INSS denied my application because of the unidad de convivencia — what does that mean?
INSS determines the household unit from the padrón and your application data. Common problems: a member was wrongly included or excluded; one member's income puts the total over the limit; the padrón does not match reality. You need a certificado de empadronamiento colectivo and a written explanation of any discrepancies in your reclamación previa.
INSS is demanding repayment of IMV — what should I do?
A resolución de reintegro also gives you 30 working days to file a reclamación previa. Explain why the demand is unlawful or why the amount is wrong. You can simultaneously request a fraccionamiento (payment plan). Do not ignore the demand — INSS can enforce collection compulsorily.
