NIE to buy property in Spain as a non-resident: why you need it and how to get it

You do not need to be resident to buy property in Spain. This guide explains why you need a NIE, the three ways to get it (through a consulate, at the Policía with EX-15, or through a representative with a power of attorney), the narrow temporary M-number exception, and why the NIE is not a residence permit.

Why you need a NIE to buy

The NIE (Número de Identidad de Extranjero) is a foreigner’s identification number and, for tax purposes, normally also serves as their NIF. The number remains unchanged even if a document carrying it expires.

The escritura and registration at the Registro de la Propiedad — Spain’s Land Registry for ownership and charges — need every appearing party’s NIF. Article 254 of the Ley Hipotecaria prevents registration while those numbers are missing.

You may buy as a non-resident. Spain repealed the former property-investor “golden visa” route from 3 April 2025, so the purchase itself creates no right to live in Spain.

Who needs it (NIE ≠ residency)

  • A foreign buyer, including an EU citizen, should obtain a NIE in advance: it is the normal foreign-person NIF and the working identifier throughout the transaction.
  • The application ground is intereses económicos. Attach a document connecting the request to a concrete purchase, such as an arras/reservation agreement or a letter from the notary or agent.
  • The NIE is not a residence permit. It does not authorise residence or work, and by itself does not guarantee a bank account, utilities or mortgage approval.

What the NIE does and does not give you

  • It lets you sign the escritura, pay taxes, register the property, set up utilities, open a bank account and arrange a mortgage.
  • Practical limit: the bank, lender and utility provider still run their own checks; the number alone does not require them to open an account, lend or contract with you.
  • A non-resident owner may owe IRNR (Impuesto sobre la Renta de no Residentes), Spain’s non-resident income tax, on rent or a sale and potentially on imputed income from an urban home kept for own use or vacant. Each co-owner files for their share.
  • Rare exception: where no NIE exists temporarily or permanently, the AEAT may assign a tax NIF beginning with M. Once a NIE is obtained, it must be reported to the AEAT and counterparties within two months and replaces the M-number. Do not rely on M for a purchase without agreeing it with the notary and registry first.

Documents and the tasa

  • Form EX-15, a valid passport and copy, and documentary proof of the economic reason.
  • Proof that tasa 790-012 has been paid; the Policía’s official page requires evidence of payment.
  • For an application in Spain, the applicant must not be here irregularly. From abroad, the application goes through a Spanish consular office.
  • For a representative, use a sufficient notarised power. If executed abroad, apostille/legalisation and an official translation may be needed unless a treaty or the form of the instrument removes that requirement; a power executed before a Spanish consulate normally avoids those foreign-document formalities.

Three ways to get the NIE

  1. Choose the route: a Spanish consulate, in person at Policía/Oficina de Extranjería, or a representative acting under a power.
  2. Complete EX-15 and attach specific proof of the economic interest in the purchase.
  3. Pay tasa 790-012 and keep the payment evidence.
  4. Submit the application at your consular appointment or your Policía cita, or have your representative file it using the poder.
  5. Receive proof of the assigned NIE. Format and delivery depend on the authority; the number itself remains permanent.
  6. Before signing, confirm every party’s NIF with the notary and the data needed for tax filing and registration.

A real case: the buyer signed the escritura while her NIE was still pending

A British buyer signed the sale deed on 26 March 2015 without a NIE because her application was still pending. The number was issued later and the notary added it in a correction instrument. The registrar refused registration and demanded that the buyer appear again or execute a new instrument. The Dirección General de los Registros y del Notariado reversed that refusal: a missing NIF was a curable defect, and recording the officially assigned NIE was a statement of fact that did not alter the parties’ consent to the sale.

The non-obvious point. Land law blocks registration of title without every appearing party’s NIF, but that is not the same as automatically invalidating the sale itself. On these facts the notary could correct the instrument without the buyer appearing again.

Outcome: the registrar’s refusal was revoked. No damages were awarded; the practical cost was delayed registration, a correction instrument and an administrative appeal.

This is an administrative land-registration resolution, not judicial precedent or permission to postpone the NIE. Current article 254 of the Ley Hipotecaria still prevents registration without a NIF; agreeing the identifier before the escritura remains the safer route.

Common mistakes

  • Treating the NIE as residence status or an entitlement to banking or credit.
  • Leaving the number until the escritura date without agreeing consequences with the notary.
  • Submitting EX-15 without concrete proof of the economic interest.
  • Assuming every power always needs apostille and sworn translation; the rule depends on where and how it was executed.
  • Ignoring IRNR after purchase even when the property is not rented.

No cita or documents rejected

  • No cita? Consider the consular route or a representative. Appointment queues and consular transmission can take longer than the decision stage itself.
  • Once the application reaches the competent register, the official maximum decision period is five days; silence is negative. The decision ends the administrative route and can normally be challenged by reposición within one month or in the administrative court within two months. Check the stated defect and evidence first.

Safest: before the escritura. The law expressly blocks registration without NIF, although the 2015 DGRN case shows that a particular omission may sometimes be cured without invalidating the sale.
