NIE to buy property in Spain as a non-resident: why you need it and how to get it
You do not need to be a resident to buy property in Spain — but you do need a NIE to sign the escritura, pay the taxes and set up utilities. This guide explains why, the three ways to get it (consulate, Policía with EX-15, or a representative with a power of attorney) and that the NIE is not a residence permit.
Why you need a NIE to buy
The NIE (Número de Identidad de Extranjero) is the foreigner ID number and, for tax purposes, their NIF. In real-estate deeds and other tax-relevant notarial acts, the parties’ NIF/NIE must appear in the escritura, so the notary will normally ask for it before signing.
You also need it to pay the purchase taxes (ITP or IVA), to register at the Registro de la Propiedad, for utilities and for a mortgage.
You can buy as a non-resident — buying property does not by itself give you residency.
Who needs it (NIE ≠ residency)
- Every foreign buyer needs a NIE — including EU citizens.
- Non-residents request the NIE for “intereses económicos” (economic interests — here, the purchase).
- The NIE is not a residence permit: it identifies you for tax and legal acts; it does not authorise you to live in Spain.

What the NIE does and does not give you
- It lets you sign the escritura, pay taxes, register the property and open utilities/bank/mortgage.
- It does not grant residence, work rights or healthcare — those are separate.
- A non-resident owner still has Spanish tax duties (e.g. non-resident income tax / IRNR) — plan for them.
Documents and the tasa
- The form EX-15 (application for the NIE).
- Valid passport (and a copy), and the justification of the economic motive (e.g. the reservation/arras contract or a letter of intent).
- The fee form tasa 790-012, paid before submitting.
- If a representative acts for you: a notarised power of attorney (poder), usually apostilled and with a sworn translation.
Three ways to get the NIE
- Choose the route: the Spanish consulate in your country, in person at a Policía Nacional / extranjería office, or a representative with a poder.
- Fill the EX-15 and prepare the economic-motive justification (e.g. the arras contract).
- Pay the tasa 790-012 and keep the stamped form.
- Submit: book the consulate appointment, or the cita at the Policía — or have your representative file it with the poder.
- Receive the NIE — a white A4 document (not a card).
- Use the NIE at the notary to sign the escritura and to pay the taxes.
Common mistakes
- Confusing the NIE with residency — it is only an ID/tax number.
- Leaving the NIE to the last minute before the signing date.
- Not documenting the economic motive for the request.
- A power of attorney that is not apostilled or not translated by a sworn translator.
