Retirement Pension in Spain (Jubilación): Who Can Claim, How Much and How to Apply
If you have worked and contributed to Spanish Social Security, you may qualify for a retirement pension (pensión de jubilación) regardless of nationality once the age, contribution and status rules are met. The amount depends on your contribution record and bases, and periods insured in other countries may count. This guide covers the rules in force in September 2026.
What jubilación is
The pensión de jubilación is a monthly payment from the INSS (Instituto Nacional de la Seguridad Social) to workers who have reached retirement age and contributed enough years. It replaces your salary for life and is adjusted annually with inflation.

Check my pension →It is a contributory benefit funded through cotizaciones (Social Security contributions) during working life. The more years you contribute and the higher your base de cotización, the higher your pension.
Who can claim
Requirements
- Reached the legal retirement age (66 years and 10 months in 2026, or 65 if you have 38 years and 3 months or more contributed)
- A minimum 15-year insurance record; under international coordination, qualifying foreign periods may be totalised
- Under the general domestic rule, at least 2 years must fall within the 15 years before the relevant retirement date; if you are registered or assimilated without an obligation to contribute, the 15-year window runs back from when that obligation ended; an international claim follows the applicable regulation or agreement
- Registration or an assimilated status is not universally required: article 205.3 LGSS also allows retirement from non-registered status if the age and contribution requirements are met; the relevant date and economic effects then differ

How much you get
Your pension is calculated from two factors: your base reguladora and a percentage based on years contributed. In 2026, INSS compares the classic 25-year calculation (300 bases divided by 350) with the transitional formula that takes the 302 highest contribution bases within the 304 months immediately before the month prior to retirement and divides them by 352.33. The more favourable result applies.
| Years contributed | Percentage of base reguladora |
|---|---|
| 15 years (minimum) | 50% |
| 16 years | 52.52% |
| 20 years | 62.38% |
| 25 years | 73.78% |
| 30 years | 85.18% |
| 35 years | 96.58% |
| 36 years and 6 months+ | 100% |
In 2026 the reference amounts for a retiree aged 65+ are €936.20/month without a spouse and €1,256.60/month with a dependent spouse, in 14 payments. They are not an unconditional floor for every award: the gap is covered through a complemento a mínimos only when the income and residence conditions are met. The overall maximum is €3,359.60/month.
Early and deferred retirement
Voluntary early retirement
You may retire up to 2 years before ordinary age with at least 35 years contributed and the remaining conditions, including that the resulting pension must exceed the applicable minimum pension at age 65. In 2026 the age threshold is 63 if ordinary age is 65, or 64 years and 10 months if it is 66 years and 10 months. Monthly reduction coefficients apply.
Involuntary early retirement
If you lost your job for one of the statutory reasons and have contributed for 33 years or more, you may retire up to 4 years early. You must also have been continuously registered as a job seeker for at least the 6 months immediately before the application. An ordinary dismissal label alone is not enough; the precise ground and evidence must fit the law.
Deferred retirement (jubilación demorada)
If you continue working after ordinary retirement age and already meet the entitlement conditions, you may choose 4% for each complete year of deferral, a lump sum calculated by the statutory formula, or a mixed option. The law does not guarantee a fixed €12,000–€15,000 per extra year.
Active retirement (jubilación activa)
Since 2025, active retirement combines work and pension with a percentage based on deferred retirement: 45% after 1 year of deferral, then 55%, 65%, 80% and 100% from 5 years; it increases by 5 points for each 12 months in active retirement, up to 100%. Some self-employed workers with qualifying indefinite employment may apply 75% if the deferral was 1 to 3 years.
Flexible retirement from 28 August 2026
Once a pension has been awarded, flexible retirement can combine it with employed work at 33–80% of a comparable full-time schedule; the pension is not paid in full but reduced in inverse proportion to the reduction in working hours. If this first compatible employed job starts at least 6 months after the pension award, the compatible amount receives an additional 25% of the pension amount being received immediately before entering flexible retirement for a 55–80% schedule, or 15% of that amount for a 33–under-55% schedule. A separate self-employed route is available if, during the 3 years before the operative event, the pensioner was not registered under any Social Security scheme as a self-employed worker; 25% of the pension is paid during that activity. The activity must be notified in advance.
Documents you need
Checklist
- DNI, NIE or passport (original + copy)
- The current official retirement application form
- Bank details and the family information requested by that form
- Your Informe de Vida Laboral is useful for checking the record, but it does not replace INSS data and is not invariably a mandatory attachment
- For foreign periods, list every country and insurance number; provide additional records only where the current form or the authority asks for them
How to apply step by step
Foreign contributions and bilateral agreements
EU/EEA and Swiss coordination, the applicable UK rules and Spain's bilateral agreements can totalise non-overlapping foreign periods for entitlement. The agreement and benefits covered must be checked country by country.
International routes in the current retirement form
- For EU states, Switzerland, Norway, Iceland and Liechtenstein, the form directs you to the Community Regulations application; UK periods follow the applicable UK coordination rules
- For bilateral retirement claims it lists Andorra, Argentina, Australia, Bolivia, Brazil, Cape Verde, Canada, Chile, Colombia, South Korea, Ecuador, El Salvador, the United States, the Philippines, Japan, Morocco, Mexico, Moldova, Paraguay, Peru, the Dominican Republic, Russia, Senegal, Tunisia, Ukraine, Uruguay and Venezuela
Check the current national-retirement form, because the route and coverage can change.
Each institution calculates a national pension where the domestic record qualifies, then a theoretical pension using totalised periods and its pro rata temporis share. It pays the higher applicable national or pro-rata result. Countries can start their shares on different dates because each keeps its own retirement age.
Common problems
- Not enough years: If you have less than 15 years in Spain, check bilateral agreements — foreign years may fill the gap. Or consider a convenio especial to continue paying voluntarily.
- Gaps in contributions: Periods without contributions in the calculation window are filled under minimum-base or specific gap rules. This can lower your pension significantly.
- Employer didn't register you: If you worked "en negro" (undeclared), those periods don't count. Report to Inspección de Trabajo — they can force retroactive registration in some cases.
- Wrong amount calculated: Check the INSS calculation against your vida laboral and contribution bases. A reclamación previa is normally due within 30 working days after notice; INSS has 45 working days to respond, followed by the separate court deadline under article 71 LRJS.
- Living abroad: A Spanish contributory pension is generally exportable, but proof-of-life and banking procedures depend on the destination and payment arrangement. Do not assume verification is automatic.
Real case: part-time work reduced the pension twice
The practical point today is precise: for a new entitlement arising after 1 October 2023, every day registered under a part-time contract counts as a full credited day regardless of hours, but the pension amount still reflects the contribution bases actually recorded. Check credited days and bases de cotización separately. Official judgment published in the BOE.

Frequently Asked Questions
Can I get a Spanish pension if I contributed in another country?
Qualifying non-overlapping periods may be totalised under the applicable EU, UK or bilateral instrument. Each institution still decides entitlement and amount under that instrument; not every country necessarily pays a separate share, including where a special short-period rule applies.
What if I don't have 15 years of contributions?
Without 15 years (including any applicable international totalisation), you cannot access the contributory pension. You may qualify for a non-contributory pension if your income is low and you have legally resided in Spain for 10 years between age 16 and the application, including the 2 consecutive years immediately before it; in 2026 the full annual amount is €8,803.20, normally paid in 14 instalments.
Can I retire early?
Potentially: voluntary early retirement requires 35+ years, the applicable age and a resulting pension above the minimum at age 65; involuntary early retirement requires 33+ years, a listed statutory cessation ground and 6 uninterrupted months as a job seeker immediately before applying. Monthly reduction coefficients apply permanently.
Do I lose my pension if I leave Spain?
A contributory pension is generally exportable, but residents abroad must follow the current INSS proof-of-life campaign. In 2026 vivencia is required twice, from January to March and again in September; from 2027 it is scheduled for January, May and September. VIVESS is available, with official alternative channels depending on the case.
Is jubilación taxed?
Generally yes: the pension is work income for IRPF and may be subject to withholding. Whether a return is required or tax is ultimately due depends on the current year's rules, total income, payers and personal circumstances; there is no safe universal €14,000 answer.
Can I work and receive jubilación at the same time?
Yes, via jubilación activa. Since 2025, the compatible pension percentage depends on how many years you deferred retirement and can range from 45% to 100%, with special rules for some self-employed workers with qualifying indefinite employment.
