Unpaid salary in Spain: how to claim it without a lawyer — 2026 action plan

Is your employer not paying your salary, nómina or finiquito — in full or on time? You have one year to claim (prescripción). The path: a written demand (burofax) → a papeleta de conciliación at the SMAC (a mandatory pre-court step) → a demanda at the Juzgado de lo Social. Late pay carries 10% annual interest; if the employer is insolvent, FOGASA steps in. Do not sign a finiquito without a reservation, and do not resign "voluntarily" instead of using the art. 50 ET route. No lawyer needed: you act on your own at the SMAC and at the first-instance Juzgado de lo Social.

How much your employer owes you

The debt, late-payment interest and — if there was discrimination — possible compensation for moral damage. The calculation does not run until you answer the discrimination question.

What counts as non-payment and how it works

Your employer must pay your salary in full and on time (Estatuto de los Trabajadores). A delay or underpayment is a breach.

Draft the demand

Everything counts: base pay, pagas extraordinarias (extras), overtime, the finiquito on termination.

Late pay carries interest — 10% per year (interés por mora, art. 29 ET).

The claim path: a written demand (burofax) → a papeleta de conciliación at the SMAC (a mandatory pre-court step) → a demanda at the Juzgado de lo Social.

Who this applies to

  • Any employee not paid their salary, nómina, extras or finiquito in full or on time — in any sector.
  • Those given an incorrect finiquito on termination.
  • Those with non-payment or delays under art. 50 ET: more than 15 days late plus three full monthly salaries owed in one year (even non-consecutive), or salary delays over six months (even non-consecutive).
  • Those whose employer is insolvent or bankrupt (then FOGASA applies).

What you are entitled to

  • The right to be paid your salary in full and on time (art. 4.2.f and 29 ET).
  • The right to 10% annual interest on late pay (interés por mora).
  • The right to file a papeleta de conciliación at the SMAC and then a demanda at the Juzgado de lo Social.
  • The right to seek extinción of the contract under art. 50 ET, with compensation as for an unfair dismissal — when the art. 50 non-payment/delay thresholds are met or the court finds just cause.
  • The right to FOGASA if your employer is insolvent or bankrupt.

Deadlines that matter

  • The limitation period for a salary claim is 1 year (prescripción, art. 59 ET) from when the payment was due.
  • A burofax interrupts the limitation period — put your demand in writing.
  • A dismissal (despido), if you were let go, is challenged within 20 working days (caducidad) — a separate, short deadline.
  • After the SMAC conciliación there is a deadline to file the demanda — do not delay.

Evidence to keep

  • The contract (contrato) and all your nóminas.
  • Bank statements showing the missing or partial payment.
  • A burofax demanding payment and proof it was sent/received.
  • Hours worked and overtime, plus correspondence with the employer.

How to claim, step by step

  • Gather the contract, nóminas and bank statements; calculate the debt (base pay + extras + interest).
  • Send the employer a written demand (burofax) — it both puts pressure on the employer and interrupts the limitation period.
  • If they still don’t pay, file a papeleta de conciliación at the SMAC (a mandatory pre-court step).
  • If there is no agreement at conciliación, file a demanda at the Juzgado de lo Social in time.
  • If the employer is insolvent or bankrupt, apply to FOGASA.
  • This is the current 2026 action plan, and none of these steps requires a lawyer: one is only mandatory to appeal the judgment (recurso de suplicación).

A real case: wages paid late and in instalments

An employee of a telecoms company in Badajoz had worked there since 2005 on 41.50 euros a day. From July 2009 each month’s salary was paid only in the following month or later, often in two or three instalments. He filed a papeleta de conciliación (17.02.2010) and sued to terminate the contract under art. 50 ET. There was no agreement at the conciliación on 08.03.2010; he announced that if the arrears were not paid within eight days he would stop attending work and accept another job offer, while keeping his claim. The company replied that it would treat this as a voluntary resignation. On 16.03.2010 he started another job; about 1,800 euros were owed that day, and the company paid almost all of it within the following month. Juzgado de lo Social nº 3 de Badajoz declared the contract terminated with compensation, and the TSJ of Extremadura upheld it. The Supreme Court (Sala General) dismissed the company’s appeal.

What was not obvious. With rare exceptions, the Supreme Court had previously required the worker to keep working until the judgment. Here it changed that doctrine: the worker may either keep working or stop attending work while bringing the claim, but at his own risk — if the court does not find the breach serious enough, leaving can cost both the job and the compensation. Six judges dissented and warned that leaving this way puts unemployment benefit at risk.

Outcome: the contract was terminated and the company had to pay 8,870.62 euros in compensation; paying off the arrears after the conciliación did not release it.

What has changed since (checked in the BOE on 17.09.2026). Since 03.04.2025 art. 50.1.b ET states that a delay means payment more than 15 days late, and that the ground exists when three full monthly salaries are owed within one year (even non-consecutive) or delays have lasted six months (even non-consecutive); the court may also accept other situations. Art. 79.7 LRJS lets the worker ask the court in such a claim for measures under which the company keeps paying salary and contributions, where continuing to work as before cannot be required. Art. 303.3 LRJS: if the company appeals a termination judgment, the worker may stop working and is treated as involuntarily unemployed. Leaving before any judgment without these mechanisms is still a risk.

Above is the claim route. This case shows when delays justify termination with compensation, and what a worker risks by leaving before the judgment.

Common mistakes

  • Waiting more than a year — the salary claim becomes time-barred.
  • Signing a finiquito marked "recibí" without a reservation (reserva de acciones).
  • Resigning "voluntarily" instead of using the art. 50 ET route — you lose the compensation.
  • Filing a demanda without the SMAC (papeleta) — it is a mandatory step.
  • Demanding only verbally, with no burofax and no evidence.

If they still don’t pay

  • If the employer ignores you, the next steps are SMAC → Juzgado de lo Social.
  • Art. 50 non-payment/delay thresholds are grounds for extinción with compensation.
  • Insolvency or bankruptcy — FOGASA covers part of the debt.
  • Gather nóminas, statements and the burofax — a well-documented case is stronger.

Common questions

How long do I have to claim unpaid salary?

One year (prescripción, art. 59 ET) from when the payment was due. A burofax interrupts the period.

Is there interest on late pay?

Yes, 10% per year (interés por mora, art. 29 ET).

Do I have to go to the SMAC before court?

Yes. The papeleta de conciliación at the SMAC is a mandatory pre-court step before the demanda.

Can I resign and still get compensation?

If the art. 50 thresholds are met (more than 15 days late plus three full monthly salaries owed in one year, or delays over six months), use extinción with unfair-dismissal-level compensation. Do not resign "voluntarily".

What if my employer is bankrupt?

FOGASA covers part of what is owed when the employer is insolvent.

I signed the finiquito — is it all lost?

Not necessarily: if you signed with a reservation, under pressure, or with calculation errors, it can be challenged.

Do I need a lawyer?

No, it is optional. At the SMAC and at the first-instance Juzgado de lo Social you can act on your own (art. 18.1 LRJS); a lawyer or graduado social is only mandatory for an appeal — recurso de suplicación (art. 21.1 LRJS).

What if the non-payment is discriminatory?

If you are not paid, or paid less, because of sex, pregnancy, origin, trade-union activity or in retaliation for a complaint, a court that finds a violation of a fundamental right also rules on compensation for moral damage (art. 183 LRJS). Only the court sets the amount.

What if I was dismissed (despido)?

That is a separate deadline: 20 working days to challenge the dismissal; one year to claim salary.
