Spanish nationality in 2 years: the route for Ibero-Americans & Brazilians
Nationals of Ibero-America (including Brazil), Portugal, Andorra, the Philippines, Equatorial Guinea and Sephardic Jews by origin can obtain Spanish nationality after just 2 years of legal residence — instead of the usual 10. And usually without losing their original nationality (Spain allows dual nationality for Ibero-Americans; Brazil allows it too). Below: who gets the 2-year route, the CCSE and DELE A2 exams (important for Brazilians), documents, the oath and the real timing.
The 2-year route
Nationality by residence (por residencia): the standard period is 10 years, but for Ibero-Americans and a few countries it is only 2 years (Código Civil, art. 22.1).
It covers nationals of Latin American countries, including Brazil, plus Portugal, Andorra, the Philippines, Equatorial Guinea and Sephardim.
Residence must be legal, continuous and immediately precede the application (the 2 years right before you file).
You need the CCSE exam (knowledge of the Constitution and society) and DELE A2 (Spanish) — unless exempt.
Who qualifies
- Nationals of Brazil and other Ibero-American countries after 2 years of legal residence.
- Nationals of Portugal, Andorra, the Philippines, Equatorial Guinea.
- Sephardic Jews by origin (on special grounds).
- The right to keep your original nationality — dual is allowed for Ibero-Americans.

Dual nationality
- Spain lets Ibero-Americans keep their original nationality (Código Civil, art. 23/24).
- Brazil also allows dual nationality — Brazilians keep their Brazilian one.
- A dual-nationality convention is in force between Spain and Brazil.
- At the oath you declare loyalty to the Constitution; the formal “renunciation” for Ibero-Americans does not mean losing your old passport.
- The right to apply after 2 years rather than wait 10.
Timing
- 2 years of legal, continuous residence immediately before applying.
- Processing then takes a further ~1–2 years (there are backlogs) — separate from the residence period.
- After approval — the oath and the inscription in the Registro Civil within the set deadline.
- The residence clock “resets” on significant gaps in legal residence — avoid any.
Documents
- CCSE and DELE A2 certificates (or proof of exemption).
- Birth certificate with an apostille and a sworn translation.
- Criminal-record certificates from Brazil (apostille + translation) and from Spain.
- Proof of legal residence (TIE), empadronamiento and certificado de antecedentes.
How to apply
- Confirm you have 2 years of legal, continuous residence.
- Pass the CCSE and DELE A2 (if not exempt) at the Instituto Cervantes.
- Gather the documents: birth (apostille+translation), criminal record BR+ES, residence.
- File the solicitud telemática (online) with a certificado digital or via a gestor.
- After approval — the oath/promise and the inscription in the Registro Civil.
Common mistakes
- Not knowing about the 2-year route and waiting 10 years.
- Letting a gap in legal residence reset the clock.
- Thinking Brazilians are exempt from DELE — they are not (Portuguese ≠ Spanish); DELE A2 is required.
- Letting the apostille/translation or the criminal record expire.
- Missing the oath and inscription deadline after approval.
Exams & refusal
- CCSE and DELE A2 are required, except for lawful exemptions (e.g. studying in Spain).
- Brazilians are NOT automatically exempt from DELE — the language is not Spanish.
- A refusal can be appealed: a recurso within the deadline.
- Keep every justificante; for “buena conducta cívica” attach clean criminal records.
