Temporary protection in Spain for people fleeing Ukraine: your rights, the card and renewal
If you were displaced from Ukraine, Spain’s temporary protection (protección temporal) gives you the legal right to live, work and use public healthcare — without going through the full asylum procedure. What temporary protection is
Temporary protection is an EU-wide emergency status (Directive 2001/55/EC) activated for people fleeing the war in Ukraine on 4 March 2022. In Spain it is called protección temporal and it gives you an authorisation to reside and work — quickly, and without going through the full asylum (asilo) procedure.
It is granted by the Oficina de Asilo y Refugio (OAR) and documented with a card (a TIE-type card showing your protection). While it is in force you have a regular, legal status in Spain.

It is aimed at people displaced from Ukraine on or after 24 February 2022 who cannot safely return:
- Ukrainian nationals who were living in Ukraine, and their family members.
- People who held international protection (or equivalent) in Ukraine and their families.
- Third-country nationals with a valid permanent residence permit in Ukraine who cannot return to their country of origin safely.
What it gives you
While your protection is valid you have, on essentially the same terms as residents:
- The right to reside and work in Spain — both as an employee and as self-employed (autónomo).
- Access to public healthcare (sanidad) through your local health centre.
- School for your children (compulsory education for minors).
- Access to social services and benefits you qualify for (for example the IMV minimum income, depending on your situation).
- Freedom to travel inside the Schengen area for short stays (up to 90 days in any 180).
How to apply
You apply through the Oficina de Asilo y Refugio. In practice this is done at a CREADE reception centre (Madrid/Pozuelo, Barcelona, Alicante, Málaga) or at a designated national police station. Bring:
- Your passport or Ukrainian ID (or any identity document you have).
- Any proof that you were in Ukraine and of when you left.
- Passport-size photos and, for children, their documents and birth certificates.
- An address in Spain where you can be reached.
Duration and renewal
Protection is granted in line with the EU decision and has been extended in stages since 2022. It does not last forever and it does not renew automatically just because the EU extends the scheme — you normally have to renew your own card before it expires.
To renew you generally need a valid passport and an up-to-date padrón (municipal registration).
Moving to a longer-term status
Temporary protection is, by design, temporary. Before it ends you may be able to move to another, more stable residence and work permit — for example through your job, through roots (arraigo) once you meet the time and other conditions, or through family.
The right route depends on how long you have been in Spain, whether you have worked and on your family situation.
Common mistakes that cause problems
- Confusing protección temporal with asylum — they are different procedures.
- Not registering on the padrón, which you need for healthcare, school and many benefits.
- Not registering with a public health centre and assigned doctor.
- Letting the card expire without renewing in time.
- Documents (name, dates) that do not match between papers.

Frequently asked questions
Is temporary protection the same as asylum?
No. It is a faster emergency status that gives you residence and the right to work right away, without deciding refugee status. You can still apply for asylum separately if you wish.
Can I work as soon as I have it?
Yes. Protección temporal includes authorisation to work as an employee and as self-employed (autónomo); you do not need a separate work permit.
Does it give me public healthcare?
Yes, on the same terms as residents. Register at your local health centre (centro de salud) with your padrón to be assigned a doctor.
What happens when it expires?
The EU extends the scheme in stages, but your own card still has to be renewed in time. Before it ends, renew it or move to another residence permit.
