You can formalise a couple in Spain by marriage or by pareja de hecho (registered partnership). Marriage vs pareja de hecho

Effect on residence and nationality

  • With an EU citizen (incl. Spanish): the foreign partner can apply for the tarjeta de familiar de ciudadano de la UE.
  • With a non-EU resident: it can support reagrupación familiar.
  • If, when applying for nationality, you have been married to a Spanish citizen for 1 year and are not legally or de facto separated, the residence period is reduced to 1 year. It is a route, not instant residence — and marriages of convenience are scrutinised.

Documents you need

  • Valid passports / NIE/TIE and recent municipal registration (empadronamiento).
  • Birth certificates and, for marriage, the certificado de capacidad matrimonial / proof of single status.
  • Foreign documents usually need an apostille and a sworn translation.
  • For pareja de hecho: proof of cohabitation as required by your comunidad.

How to formalise it

  1. Decide between matrimonio and pareja de hecho for your situation.
  2. Gather the documents (apostille + sworn translation for foreign ones).
  3. Marriage: start the acta/expediente matrimonial with the Registro Civil or another competent authority, such as a notary where available. Pareja de hecho: register at your comunidad's registry.
  4. Complete the ceremony / the inscription.
  5. If it gives a residence route, apply for the tarjeta de familiar de la UE or the reagrupación.
  6. Update municipal registration (padrón) if needed and keep the marriage certificate or Registro Civil entry.

Common mistakes

  • Thinking marriage = automatic residence — it is a route, not instant.
  • Foreign documents without apostille or sworn translation.
  • Assuming pareja de hecho equals marriage everywhere — it varies by comunidad and purpose.
  • Underestimating the scrutiny of suspected marriages of convenience.
